총칙

본 이용약관은 본 서비스가 운영하거나 제공하는 애플리케이션(모바일, 태블릿, 웨어러블, 데스크톱 앱을 포함) 및 관련 웹사이트에 적용됩니다.

제1조 일반사항

이용자가 당사의 서비스를 이용하는 경우 본 약관에 동의한 것으로 간주됩니다. 이용 전에 본 약관을 주의 깊게 읽어주시기 바랍니다.

이용자가 본 약관에 동의하지 않는 경우 서비스 이용을 중단하고, 설치한 애플리케이션을 삭제하여야 합니다.

제2조 정의

1. "이용자"란 본 약관에 동의하고 당사의 서비스를 이용하는 개인 또는 법인을 의미합니다.
2. "대상 설비"란 당사 또는 당사가 지정한 제3자가 서비스 제공을 위하여 운영하는 서버, 네트워크 장비 및 기타 설비를 의미합니다.

제3조 금지사항

이용자는 당사의 서비스를 이용함에 있어 다음 각 호의 행위를 하여서는 안 됩니다.

1. 저작권, 초상권, 명예권, 프라이버시 기타 권리를 침해하는 행위
2. 당사 또는 제3자의 저작권, 지식재산권 또는 재산상 이익을 침해하거나 침해할 우려가 있는 행위
3. 법령 또는 공공질서와 선량한 풍속에 위반되거나 위반될 우려가 있는 행위
4. 다른 이용자 또는 제3자에게 불이익을 주거나 줄 우려가 있는 행위
5. 당사 서비스의 운영을 방해하거나 방해할 우려가 있는 행위
6. 당사 또는 당사 서비스의 신용을 훼손하거나 훼손할 우려가 있는 행위
7. 서비스에 포함된 소프트웨어 또는 저작물을 리버스 엔지니어링, 디컴파일 또는 디스어셈블하는 행위
8. 대상 설비에 대한 무단 접근 또는 저장된 정보의 무단 변경이나 삭제 행위
9. 바이러스 등 유해한 컴퓨터 프로그램을 대상 설비에 전송하는 행위
10. 대상 설비에 과도한 부하를 가하는 행위
11. 로봇, 크롤러, 스크래핑 도구 등 자동화된 수단을 이용하여 서비스의 콘텐츠를 수집, 복제 또는 재배포하는 행위
12. 당사 콘텐츠를 인공지능, 머신러닝 또는 대규모 언어모델의 학습, 미세조정, 검색증강생성에 이용하는 행위
13. 당사 콘텐츠를 포함한 데이터세트를 생성하여 제3자에게 제공하거나 판매하는 행위
14. 당사 콘텐츠를 복제, 각색, 요약 또는 재작성하여 제3자의 제품 또는 서비스에 사용하는 행위
15. 기타 당사가 부적절하다고 판단하는 행위

제4조 면책사항

1. 당사의 서비스는 있는 그대로 제공됩니다. 당사는 서비스의 특정 목적 적합성, 상품성, 정확성, 신뢰성, 완전성 또는 제3자 권리의 비침해성에 대하여 명시적 또는 묵시적으로 어떠한 보증도 하지 않습니다.
2. 당사는 이용자의 서비스 이용과 관련하여 발생한 어떠한 손해에 대해서도 책임을 지지 않습니다.
3. 당사는 서비스 이용 중 또는 그와 관련하여 발생할 수 있는 데이터 유실, 동기화 오류, 백업 실패, 복원 실패 또는 버전 차이로 인한 문제에 대하여 책임을 지지 않습니다.
4. 이용자는 자신의 책임 하에 서비스를 이용하여야 하며, 그 이용으로 인해 당사에 손해가 발생한 경우 이를 배상하여야 합니다.
5. 당사 서비스에는 제3자가 운영하는 외부 웹사이트로의 링크가 포함될 수 있으며, 당사는 해당 외부 웹사이트의 내용, 정확성, 안전성 또는 적법성에 대하여 책임을 지지 않습니다.

제5조 외부 API 및 인공지능 기능

1. 당사 서비스는 Apple Weather 및 기타 외부 서비스 제공자의 API를 이용하여 날씨 정보 등 일부 기능을 제공할 수 있습니다.
2. 당사 서비스는 이용자가 선택적으로 사용할 수 있는 이모지 추천 기능을 제공하기 위하여 OpenAI 등 외부 인공지능 서비스를 이용할 수 있으며, 해당 기능의 이용 시 별도 안내 또는 동의 절차가 제공될 수 있습니다.
3. 이용자가 전항의 인공지능 기능을 사용하는 경우, 추천 생성을 위하여 이용자가 입력한 텍스트와 서비스 운영 및 남용 방지에 필요한 범위의 정보(예: 설치 식별자, 앱 버전, 접속 환경 정보)가 당사 서버 및 외부 인공지능 서비스 제공자에게 전송되거나 처리될 수 있습니다.
4. 이용자는 인공지능 기능 사용 시 추천 생성에 필요하지 않은 민감한 개인정보, 타인의 개인정보, 비공개 정보 기타 민감한 내용을 입력하지 않아야 합니다.
5. 전항의 기능은 외부 서비스 제공자의 시스템, 네트워크 환경, 데이터 품질, 정책 변경 또는 기타 사유에 따라 지연, 중단, 변경 또는 종료될 수 있습니다.
6. 당사는 외부 API를 통해 제공되는 정보 또는 인공지능 기반 추천 결과의 정확성, 완전성, 적합성, 연속성 또는 특정 목적 부합성을 보증하지 않습니다.
7. 이용자는 인공지능 기반 추천 결과가 자동 생성된 참고 정보임을 이해하며, 해당 결과의 이용 및 최종 판단에 대한 책임은 이용자에게 있습니다.
8. 외부 API 또는 인공지능 기능의 이용과 관련한 정보 처리는 당사의 개인정보처리방침 및 각 외부 서비스 제공자의 정책에 따를 수 있습니다.

제6조 서비스의 변경, 중단 또는 종료

당사는 이용자에 대한 사전 통지 없이 언제든지 어떠한 이유로든 서비스의 전부 또는 일부를 변경, 중단 또는 종료할 수 있습니다.

제7조 위반에 대한 조치

1. 이용자가 본 약관을 위반한 경우 당사는 사전 통지 없이 해당 이용자의 접근을 제한하거나 기타 필요하다고 판단하는 조치를 취할 수 있습니다.
2. 이용자의 본 약관 위반으로 인해 당사에 손해가 발생한 경우 이용자는 그 손해를 배상하여야 합니다.
3. 당사 콘텐츠에 대한 저작권 침해가 발생한 경우 당사는 금지청구, 손해배상청구 및 이에 수반하여 발생한 합리적인 비용의 회수를 청구할 수 있습니다.

제8조 이용자 정보의 취급

1. 당사는 이용자 정보를 당사의 개인정보처리방침에 따라 처리합니다.
2. 이용자가 인공지능 추천 등 선택 기능을 이용하는 경우, 당사는 서비스 제공, 품질 개선, 남용 방지 및 관련 문의 대응을 위하여 필요한 범위의 정보를 개인정보처리방침 및 서비스 내 안내에 따라 처리하거나 외부 서비스 제공자와 공유할 수 있습니다.
3. 이용자는 당사 서비스를 이용함으로써 개인정보처리방침에 따른 정보 처리에 동의한 것으로 봅니다.
4. 당사는 당사의 단독 재량으로 이용자가 제공한 정보 및 데이터를 개인을 식별할 수 없는 형태로 가공할 수 있으며, 그러한 통계정보를 사용하거나 공개할 수 있습니다.

제9조 약관의 변경

당사는 이용자의 사전 동의 없이 본 약관을 개정할 수 있습니다. 개정된 약관은 서비스에 게시되는 즉시 효력이 발생하며, 이용자는 이러한 변경을 수락한 것으로 봅니다.

제10조 권리와 의무의 양도

1. 이용자는 당사의 사전 서면 동의 없이 본 약관상 지위 또는 본 약관에 따라 발생하는 권리나 의무의 전부 또는 일부를 양도, 이전, 재허락, 담보 제공 또는 기타 방법으로 처분할 수 없습니다.
2. 당사가 서비스와 관련된 사업을 제3자에게 이전하는 경우, 당사는 본 약관상 지위와 함께 모든 권리 및 의무, 그리고 이용자 정보를 해당 제3자에게 이전할 수 있으며 이용자는 이에 미리 동의한 것으로 봅니다.

제11조 비밀유지

1. 이용자는 당사의 사전 서면 동의 없이 서비스 이용과 관련하여 당사로부터 취득한 비공개 기술상, 영업상 또는 기타 정보를 제3자에게 공개하거나 누설하여서는 안 됩니다.
2. 전항의 비밀유지의무는 서비스 이용 종료 후에도 계속 유효합니다.

제12조 분리 가능성

본 약관의 어느 조항이 관련 법령에 따라 전부 또는 일부 무효 또는 집행 불가능하다고 판단되더라도 나머지 조항은 계속하여 효력을 유지합니다. 당사와 이용자는 해당 무효 또는 집행 불가능한 조항의 본래 의도와 효과를 최대한 반영하는 유효한 조항으로 이를 대체하기 위해 노력합니다.

If you do not agree to these Terms, you must stop using the service and delete any installed applications.

Article 2. Definitions

1. "User" means any individual or entity that agrees to these Terms and uses our service.
2. "Covered Facilities" means the servers, network equipment, and other facilities operated by us or a third party designated by us for the purpose of providing the service.

Article 3. Prohibited Conduct

When using our service, users must not engage in any of the following conduct.

1. Infringing copyrights, portrait rights, reputation, privacy, or other rights
2. Infringing or potentially infringing our or any third party's copyrights, intellectual property rights, or proprietary interests
3. Violating or potentially violating laws, public order, or accepted standards of decency
4. Causing or potentially causing disadvantage to other users or third parties
5. Interfering with or potentially interfering with the operation of our service
6. Damaging or potentially damaging our reputation or the credibility of our service
7. Reverse engineering, decompiling, or disassembling software or other works included in the service
8. Unauthorized access to Covered Facilities or unauthorized alteration or deletion of stored information
9. Transmitting harmful computer programs such as viruses to Covered Facilities
10. Imposing excessive load on Covered Facilities
11. Using robots, crawlers, scraping tools, or other automated means to collect, copy, or redistribute service content
12. Using our content to train, fine-tune, or support retrieval augmented generation for AI, machine learning, or large language models
13. Creating datasets containing our content and providing or selling them to third parties
14. Copying, adapting, summarizing, or rewriting our content for use in third-party products or services
15. Any other conduct that we determine to be inappropriate

Article 4. Disclaimer

1. Our service is provided on an "as is" basis. We make no express or implied warranties regarding fitness for a particular purpose, merchantability, accuracy, reliability, completeness, or non-infringement of third-party rights.
2. We are not liable for any damages arising in connection with a user's use of the service.
3. We are not liable for any data loss, synchronization errors, backup failures, restoration failures, or issues caused by version differences that may occur during or in connection with the use of the service.
4. Users must use the service at their own responsibility, and if damage occurs to us as a result of such use, the user must compensate us for that damage.
5. Our service may contain links to external websites operated by third parties, and we are not responsible for the content, accuracy, safety, or legality of those external websites.

Article 5. External APIs and AI Features

1. Our service may use Apple Weather and other third-party service provider APIs to provide certain features such as weather information.
2. Our service may use external AI services, including OpenAI, to provide optional emoji suggestion features, and separate notice or consent procedures may be provided when using such features.
3. If a user uses the AI feature described above, the text entered by the user and information required for service operation and abuse prevention, such as installation identifiers, app version, and connection environment information, may be transmitted to or processed by our servers and external AI service providers for suggestion generation.
4. When using AI features, users must not enter sensitive personal information that is unnecessary for suggestion generation, personal information about others, non-public information, or other sensitive content.
5. These features may be delayed, suspended, changed, or discontinued due to the systems of external service providers, network environments, data quality, policy changes, or other reasons.
6. We do not guarantee the accuracy, completeness, suitability, continuity, or fitness for a particular purpose of information provided through external APIs or AI-generated recommendations.
7. Users understand that AI-generated recommendations are automatically generated reference information, and the user is solely responsible for the use of such output and any final decisions based on it.
8. The handling of information related to the use of external APIs or AI features may be subject to our Privacy Policy and the policies of each external service provider.

Article 6. Changes, Suspension, or Termination of the Service

We may change, suspend, or terminate all or part of the service at any time and for any reason without prior notice to users.

Article 7. Measures for Violations

1. If a user violates these Terms, we may restrict that user's access or take any other measures we deem necessary without prior notice.
2. If damage occurs to us due to a user's violation of these Terms, the user must compensate us for such damage.
3. In the event of copyright infringement involving our content, we may seek injunctive relief, damages, and recovery of reasonable related costs.

Article 8. Handling of User Information

1. We handle user information in accordance with our Privacy Policy.
2. If a user uses optional features such as AI recommendations, we may process or share the necessary scope of information with external service providers for service provision, quality improvement, abuse prevention, and related inquiry response in accordance with the Privacy Policy and notices within the service.
3. By using our service, users are deemed to have agreed to the processing of information described in the Privacy Policy.
4. At our sole discretion, we may transform information and data provided by users into a form that does not identify individuals, and we may use or disclose such statistical information.

Article 9. Changes to the Terms

We may revise these Terms without obtaining prior consent from users. Revised Terms become effective immediately upon posting in the service, and users are deemed to have accepted such changes.

Article 10. Assignment of Rights and Obligations

1. Users may not assign, transfer, sublicense, pledge, or otherwise dispose of all or part of their status under these Terms or any rights or obligations arising under these Terms without our prior written consent.
2. If we transfer the business related to the service to a third party, we may transfer to that third party our status under these Terms, all related rights and obligations, and user information, and users are deemed to have consented to such transfer in advance.

Article 11. Confidentiality

1. Without our prior written consent, users must not disclose or leak to any third party any non-public technical, business, or other information obtained from us in connection with use of the service.
2. The confidentiality obligations in the preceding paragraph remain effective even after use of the service ends.

Article 12. Severability

Even if any provision of these Terms is determined to be wholly or partially invalid or unenforceable under applicable law, the remaining provisions will remain in full force and effect. We and users will endeavor to replace the invalid or unenforceable provision with a valid provision that most closely reflects its original intent and effect.
